Introduction

These Terms of Service ("Agreement") constitute a legally binding agreement between you and LODance ("Company," "we," "us," or "our") governing your use of our website, mobile applications, and related services (the "Service").

By accessing, browsing, or using LODance in any manner, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions in this Agreement. If you do not agree with any part of these terms, you may not use the Service.

1. Eligibility

You must be at least 13 years of age to use LODance. Users under 18 may use the Service only under parental or legal guardian supervision. By using LODance, you represent that you meet these age requirements and have the legal authority to enter into this Agreement.

2. Acceptable Use

You agree not to use LODance for any unlawful purpose or in any way that violates these Terms. You shall not:

• Harass, threaten, defame, or discriminate against other users
• Post obscene, abusive, or offensive content
• Attempt to gain unauthorized access to the Service or its systems
• Upload viruses, malware, or other harmful code
• Violate any applicable laws or regulations
• Impersonate or falsely represent your identity or affiliation
• Spam, phish, or engage in scams or fraud

We reserve the right to suspend or terminate your account if we determine that you have violated these Acceptable Use terms.

3. User-Generated Content

LODance allows you to create and store content such as lesson notes, dance progress logs, and personal annotations ("User Content").

• Your Ownership: You retain full ownership of all User Content you create
• Our License: By creating User Content, you grant LODance a non-exclusive license to store, display, and process your content as necessary to operate the Service
• Privacy: Your User Content is private by default and not shared with other users unless you explicitly choose to share it
• Responsibility: You are solely responsible for the content you create. You guarantee that your User Content does not violate any laws or third-party rights

4. Intellectual Property Rights

LODance contains intellectual property owned by the Company or our licensors, including text, graphics, logos, images, and software. The dance history content, figure database, and research are proprietary to LODance. You may not reproduce, distribute, modify, or transmit this content without our prior written consent, except as permitted by law.

You may access and display content for personal, non-commercial use only.

5. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include:

• Violation of these Terms of Service
• Harassment or abuse of other users
• Violation of applicable laws
• Inactivity for an extended period

Upon termination, your access to the Service will cease immediately. You may request a copy of your personal data before account deletion.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LODANCE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Damages from viruses, malware, or unauthorized access

LODANCE'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

7. Disclaimer of Warranties

LODANCE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

8. Indemnification

You agree to indemnify and hold harmless LODance, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable laws or third-party rights.

9. Changes to Terms

We may revise these Terms at any time without notice. Your continued use of LODance following any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Massachusetts, without regard to its conflict of law principles.
